Our Terms & Conditions
 

We are excited you chose Luxsy Palm Springs!  We are a boutique management company that goes above and beyond our guest’s expectations.  We want you to fully enjoy your vacation, so we have outlined the rules and regulations that pertain to this vacation home and the City of Palm Springs vacation home ordinances (which apply if the property is in the City of Palm Springs).  Please read this document and pay extra attention to the Palm Springs Good Neighbor policy.

Prices do not include Transient Occupancy Taxes, for which you will responsible for as outlined on the booking site.

AT TIME OF BOOKING AND MAKING PAYMENT, YOU HAVE AGREED AND ACCEPTED OUR TERMS AND CONDITIONS AS OUTLINED IN THIS DOCUMENT. 

RESERVATION CONFIRMATION. You cannot enter the home until all items below have been received by Luxsy Palm Springs:
1. Completed, signed Vacation Rental Agreement.

2. 100% of the Security Deposit (if any), 100% of the Premium Protection Program premiums, plus:

  q If more than 45 days of arrival, 50% of any special service fees (i.e. concierge items, pool side massages, private chef fees, bike rentals, etc.) and 50% of all other amounts due. The remainder will be due 45 days before arrival.

    q  If 45 days or less than arrival, 100% of all charges.

3.Copy of driver's license or passport

We will not reserve the home for you without these items above.  When your completed rental package is received, we will sign the agreement and return it to you by email as confirmation of your rental.  If you do not receive the agreement, signed by Host, please contact us; you may not have a confirmed rental. 

Payment amounts are specified on the Pricing and Payments section of the booking website.

All payments under this Agreement should be made payable to Luxsy Vacations, Inc. dba Luxsy Palm Springs.

Payments may be made by mail or online.

Your final payment is due 45 days prior to your arrival. 

You will receive a welcome email 10 days prior to your arrival with special access codes (which will not be active until the scheduled arrival time) and information regarding gaining access to the property.

MINIMUM AGE REQUIREMENT. Guest of record must be 25 years of age or older for Palm Springs homes and the city of Rancho Mirage requires signer to be 30 years of age or older.

CHECK IN & OUT Guest’s check in time is 4:00 PM, and Guest’s departure time is 10:00 AM (unless Host has approved in writing an early check in or delayed departure time and Guest has paid all fees due for early check in or delayed departure).    Because other guests may be arriving on Guest’s departure date, Guest must vacate by 10:00 AM to provide adequate time for cleaning before the next guests arrive. IF GUEST CONTINUES TO OCCUPY THE PROPERTY AFTER THE SCHEDULED DEPARTURE TIME, HOST MAY SUFFER DAMAGES SUCH AS INCREASED CLEANING COST AND LOST RENT FROM THE NEXT SCHEDULED GUEST (BOTH CURRENTLY AND IN LOST FUTURE RENTALS). HOST’S DAMAGES FOR LOST FUTURE RENTAL INCOME MAY NOT BE SUSCEPTIBLE TO READY CALCULATION. HOWEVER, HOST AND GUEST AGREE THAT $250.00 PER HOUR OF HOLDOVER IS A REASONABLE ESTIMATE OF ACTUAL DAMAGES THAT HOST MAY SUFFER FOR LOST FUTURE RENTAL INCOME.  IF GUEST FAILS TO VACATE HOUSE IN A TIMELY MANNER, THEY MUST PAY $250.00 PER EACH HOUR (OR PORTION OF AN HOUR) THAT THEY FAIL TO VACATE THE PROPERTY.

 

KEYS AND GATE CARD.  You will be greeted at the home at your scheduled time of your arrival.  Please coordinate your arrival time with Luxsy Palm Springs and communicate if there are any delays.  Arrivals after 6:00pm will incur a late check-in fee of $35.00.  In the event that extensive cleaning and/or repairs are required, check-in may be delayed until after 4:00pm. There will be no refund or prorated refund for delayed check-in due to extensive cleaning and/or repairs. Guest is not permitted on the property prior to check-in. Guest will be given a special access code for a keyless entry system prior to arrival 10 days before arrival (although the code will not be active until the scheduled arrival time).  Garage door opener and gate cards will be located in the home if required.  Garage door openers, keys and any other access items must be returned to the home prior to departure to avoid a delay in receiving the security deposit.  Security deposit will not be returned until Luxsy receives it back from Guest.  A fee of $150 will be accessed for the loss of garage door opener and $50 for a key.

PROPERTY AMENITIES. A list of amenities provided with the property is listed on the online description.  Guest is responsible for returning all amenities in the same condition as received.

LINENS AND TOWELS. Each bedroom will be provided with a luxury set of sheets, blanket and top sheet along with two down pillows and two firmer pillows.  Each bathroom will have four luxury bath towels, hand towels, wash cloths and bath mats.  Pool towels provided for each occupant. The master bedroom will have two Luxsy resort style robes.  If items are damaged or removed from the home, the following fee will be charged.

Sheets $79 per sheet, Cover Sheet $65, Bed Blanket $75,  Pillow Case $15,  Bath towels $30, Hand towels $20, Washcloth $15, Bath Mat $25 Pool Towel $35, Pillow $45, Luxsy Robe $95.

ENTRY OF PROPERTY DURING STAY.  Luxsy Palm Springs and their representatives have the right to enter the property at any time for the purpose of making repairs refilling supplies, housekeeping, verifying Guest is in compliance of the terms of this agreement, or to investigate disturbances, or to check for damages. 

MAXIMUM OCCUPANCY/ASSIGNMENT/SUBLETTING.  The property is for single family residential use only and has a maximum occupancy of ___ people.  The house has __ bedrooms and ___ bathrooms.   Guest may not assign or sublet all or any part of the property.  

PAYMENTS.  Payments should be sent to the Host and be paid online.     Payment amounts are specified on the Pricing and Payments section of the booking website. At the time this Vacation Rental Agreement is signed, Guest must pay 100% of the Security Deposit (if any), 100% of the Premium Protection Program premiums, + 100% of Vacation Rental Insurance premiums (if optioned), plus:

q If the Vacation Rental Agreement is signed more than 45 days before arrival, 50% of any special service fees (i.e. concierge items, pool side massages, private chef fees, bike rentals, etc.) and 50% of all other amounts due. The remainder will be due 45 days before arrival.

         q  If the Vacation Rental Agreement is signed 45 days or less than arrival, 100% of all charges.

All payments under this Agreement should be made payable to Luxsy Vacations, Inc. dba Luxsy Palm Springs.

Payments are made online.

Final payment is due 45 days prior to Guest’s arrival.

NONREFUNDABLE CLEANING FEE.  The nonrefundable cleaning fee specified on the booking website is nonrefundable. It is for normal cleaning of the property. Additional cleaning fees may apply if the property requires heavy cleaning.  Guest should leave the property in the same condition as when they arrived, other than normal cleaning. 

REFUNDABLE SECURITY DEPOSIT.  Host must receive the refundable security deposit specified on the booking website.  The security deposit will be refunded within 18 days after Guest vacates the property, less costs for a) repairing damages caused by Guest, occupants, or invitees; b) extra cleaning beyond normal cleaning; and/or c) paying any other amount due from Guest to Host. Host does not pay interest on security deposits.

PROPERTY PROTECTION PROGRAM.   A Property Protection Program is required for the charge of $79 per stay.  The damage Property Protection Program covers up to $3,000.00 in accidental damage to the rented unit that occurs during Guest’s covered occupancy. Host’s property manager is responsible for filing all program claims on behalf of Guest, and Guest will be notified in writing of any claim. Guest verification may be required in certain cases, and Guest agrees to provide verification upon request. Guest will be responsible for the cost of repair of all damages that exceeds the coverage limit of the Property Protection Program for which are not covered claims. The amount Guest pays for the Property Protection Program includes any related insurance, technology-support, service, and claims adjudication costs, along with administrative fees charged by the Host’s property manager for making this coverage available. This program does not cover intentional damage, damages resulting from the negligence of Guest, or damages from non-compliance with the terms of this agreement. Determination of actual damages will be at the sole discretion of the Host’s property manager and the program underwriter. VACATION RENTAL INSURANCE.  Vacation rental insurance is available to reimburse for pre-paid, non-refundable expenses due to unplanned circumstances.  Host strongly recommends Guest purchase this protection at the time of booking and it can be added up to 45 days prior to arrival.  This is an optional program.

FAILURE TO PAY ALL AMOUNTS DUEHost will have no obligation to give possession of the property to Guest if Guest hasn’t paid all amounts due (rent, cleaning fee, security deposit and any other amounts due) in a timely manner as outlined above.

FAILURE TO PROVIDE DOCUMENTATION. Host will have no obligation to give possession of the property to Guest if Guest has not provided all of the documentation required.

CONDUCT AND COMPLIANCE.  The property is in a residential neighborhood. Loud, noisy or offensive activities and/or parties or large gatherings are not allowed. NO AMPLIFED MUSIC at any time can be played outside.  Commercial photography and events are not permitted without prior written Host consent and written permission.  Should permission be granted for an event or commercial photography, Guest must purchase special insurance and additional fees will apply.  Guests are responsible for Guest’s actions and the actions of the other occupants and invitees, who:

  • May not create a nuisance, and may not disturb neighbors with excessive noise (loud televisions, stereos, voices, etc.) or otherwise.  Please note that the quiet hours are 10 pm to 10 am.  Move indoors after 10 pm, however if Guests choose to be outside, please beware Guests could violate the city’s noise ordinance and this property does have a decibel reader. 

Please note that the surrounding neighbors are giving a special phone number to call 24/7 in the event there is a disturbance. 

  • Must comply with all rules, regulations and Host instructions (including posted signs), and all laws, statutes, ordinances, and requirements of all city, county, state, and federal authorities;
  • Must notify Host of any dangerous condition, deterioration or damage to the home so Host can make necessary repairs;
  • Are responsible for damage to the property caused by Guest, other occupants and invitees. Guest agrees to indemnify, defend (with counsel of Host’s choice), and hold Host harmless for any liability, costs (including reasonable attorney fees), or claims resulting from Guest’s breach of this Agreement or the negligence, violation of law, HOA rule violations, or willful misconduct of Guest, other occupants or invitees.  This obligation includes the obligation to pay for the time of Host or Host’s agent spent dealing with these issues at an hourly rate of $225.00.
  • The property may be governed by a Homeowner’s Association. If the property is governed by a HOA, the property website will specify that and contain relevant HOA documents with HOA requirements, restrictions, rules and regulations.  Guest must comply with all HOA requirements, restrictions, rules and regulations.  If Host is fined by the HOA, the HOA fines will be passed on to Guest.

 

RING DOORBELL AND DECIBEL READER.  The property is located in a quiet residential neighborhood. The City and Host enforce all applicable city ordinances that relate to occupancy, noise, and parking. The property has a Ring doorbell that records video and audio.  The property also has a noise monitoring system that records noise levels and sends alerts to the property manager when excess noise is detected. THE CITY MAY ASSESS FINES OF $1500.00 OR MORE, PLUS ANY CITATIONS AS A RESULT OF NOISE OR OTHER VIOLATIONS.  In addition to the fine as outlined above, violations of the noise ordinance will be subject to immediate eviction with no refund, and forfeiture of the entire security deposit.

INTERNET AND UTILITIES.  Internet service, electric, water, trash and gas (non-pool related) service are provided at no extra charge.    Guest may use normal household amounts of utilities for residential use only, and utilities may not be used for business, commercial or fee-generating purposes.  Guest staying longer than 29 days will be required to pay for their own use of these expenses at a cost plus 10% fee. For guest staying more than 29 days there will be a $1000 utility deposit due at time of booking. If guests uses less than $1000 a refund will be given within 15 days after check-out.  If guests uses more than the $1000 deposit, the difference will become due.    Please be considerate of the Host’s costs and never leave the AC on with windows or doors open.  Also, please never turn the thermostat below 74 degrees, it will freeze up resulting in the home to not cool properly.

CANCELLATION POLICY. If Guest cancels this Agreement more than 45 days prior to arrival date, [whether (a) by notice to Host or (b) by failing to make payments, when due], Host will attempt to locate a replacement guest.  If a replacement guest is located, Host will retain cancellation fee equal to 15% of total amount due plus the Booking Fee.  Refunds will be paid only after Host has received the full rental payment from the replacement guest.  If Host does not find a replacement guest, you will not receive any refund, other than special request items or services which can be cancelled by Host at no charge to Host.

If a guest cancels this Agreement 45 days or less before arrival date, Guest will not receive any refund, other than special request items or services which can be cancelled by Host at no charge to Host.  

HOST STRONGLY RECOMMENDS YOU CONSIDER TRAVEL - VACATION INSURANCE- Available at check-out when making your reservation.

By making a reservation on our booking site, you accept and agree to the relevant cancellation and no-show policy outlined in the terms and conditions,  and to any additional (delivery) terms and conditions that may apply to your reservation, including for services rendered and/or products.

HOUSE MAINTENANCE. On Guest’s arrival at the property, please let Host know immediately if the property has any maintenance needs.  Host and Manager do not warranty or guarantee the property and are not liable for property malfunctions or repair needs, as they cannot always be foreseen.

PETS: Unless otherwise specified in the Vacation Rental Agreement, pets are not authorized on this property. Guest assumes full responsibly for pet behavior, safety and the safety of others including vendors and guests.  If an unauthorized animal is brought onto the property without permission a charge of $1,500 will be placed on the credit card immediately and the security deposit will not be refunded and Guest will be immediately evicted from the property.   If pets are approved in writing,  pets are not to be left unattended in the home at any time.  Please be sure to pick up after your pet and dispose of droppings in a tied plastic bag, otherwise a clean up fee will be assessed in the amount of $50.  Additionally, should excessive pet hair, pet nose window markings, or evidence of pets on furniture, pet stains,  or any other item that is not part of the normal clean of a  home an additional cleaning fee will be deducted out of the $500 refundable pet deposit at the discretion of the manager.  Pets are not allowed in the pool.  Failure to adhere to these rules will result in immediate eviction with no refund.

GARBAGE DISPOSAL. Please take garbage to the receptacles on side of property. 

NO ROOF ACCESS.  Do not stand, sit, sleep, climb, lie, walk or run on the property roof. 

NO SMOKING ALLOWED IN HOME.   Any evidence of smoking in the home or on a covered ceiling/patio will result in a $1,500.00 charge to the credit card on file or deducted from the security deposit.

INSURANCE.  Host does not insure Guest’s personal property, and Host, Host’s agents, and the HOA will not be liable for any damage or injury to Guests, or to any of Guest’s property, including Guest’s vehicles, whether due to theft, fire, vandalism, rain, water, criminal or negligent acts of others or any other cause.  Host is not responsible for personal property that is left behind.

BEFORE VACATING.  Before vacating, place all dishes in dishwasher and start cycle, wash all dishes that do not belong in dishwasher, and place all trash in outside receptacles.  Leave all keys and garage door opener on kitchen table. Guest agrees to leave the property in the same condition they received the property in at check in.  Please turn off all lights and turn air-conditioning to 80 degrees before vacating.  If you leave an item behind, we can make arrangements to ship this to you starting at $59.00.

AVAILABILITY.  If the property is not available for Guest’s occupancy on Guest’s arrival date for any reason beyond Host’s control (whether due to damage to the property, holdover guests or other events beyond Host’s control), Host will not be liable for the delay.  The Agreement will be canceled and Host will immediately refund all amounts that Guest has paid.  Until check in, Host reserves full discretion to assign Guest to a different vacation rental property and will make a reasonable effort to substitute a property of an equal size and style.

TRANSIENT OCCUPANCYGuest is renting the home as a transient lodger, and will be responsible for all transient occupancy taxes.  Host retains full legal, possessory and access rights to the home.

GUEST REPRESENTATIONS. Guest warrants that all statements that Guest has made in this Agreement and any application are accurate. Host may cancel this Agreement, at any time, upon discovering that any information Guest has provided is incomplete or inaccurate in any way.  

MISCELLANEOUS PROVISIONS. Time is of the essence. This is a legally binding contract. This Agreement will be governed by and construed in accordance with California law. Any legal action arising out of or relating to this Agreement will be filed in Riverside County, California.  Guest is responsible for payment, deposits and all facets and terms of the Agreement, including any addenda, and the booking website. If there is more than one Guest named above, all Guests are jointly and individually responsible under this Agreement.  In any action or proceeding arising out of this Agreement, the prevailing party will be entitled to reasonable attorney’s fees and costs.  All previous agreements (whether written or oral) are incorporated in this Agreement which constitutes the entire contract. It may not be contradicted by evidence of any previous agreement or contemporaneous oral statements or agreement. If any portion of this Agreement is unenforceable or invalid it will have no effect, but all the remaining provisions of the Agreement will remain in full force.  This Agreement will not be construed as if it had been prepared by one of the parties, but rather as if both parties have prepared it. Any waiver of any breach will not be construed as a continuing waiver of the same or any subsequent breach. Waiver may not be established by course of conduct.  No waiver will exist unless written and signed by the parties. The parties agree to accept electronically or faxed signed copies of this contract in lieu of originals.

SWIMMING POOL/SPA.  The Property may have a swimming pool and/or spa. Special care is required to avoid swimming pool and spa hazards. There is no lifeguard present at the pool and/or spa.

Under California state law, no children under the age of 14 may use a swimming pool or spa without adult supervision.  Guest must take action at all times to prevent unauthorized or unsupervised people from using or accessing the pool and/or spa.  Please be careful.  Be vigilant in supervising people and pets who are using the pool or spa or are near the pool or spa. Guest is responsible for the conduct of Guest, occupants, and their invitees in, at, or near the pool and spa. Guest is responsible for use of the pool and spa by Guest, occupants, and invitees in accordance with manufacturer’s recommendations.

Do not allow access to the yard to anyone who is not water-safe without supervision.  Host makes no representation or warranty regarding the condition of the pool or spa or their use by any person.

For safety reasons, people should not use the pool and/or spa alone, should not dive into the pool or spa, and no intoxicated persons may use the pool or spa.

It is possible that people, including Guest, occupants, invitees or others may injure themselves, slip, fall, trip, drown or encounter other risks by using the pool or spa. Although this list of potential hazards is not exhaustive, it is representative of some of the risks inherent with the presence of a pool or spa.  Guest understands that these risks exist, and whether or not Guest understands the exact nature of each and every risk, they freely and voluntarily assume these risks. To the maximum extent allowed by law, Guest agrees to assume all risk of harm, and forever waive, release, and relinquish all claims (of whatever kind or character) against Host in connection with any injury, death, loss, or damage relating to the Property’s swimming pool and/or spa, on behalf of Host and Host’s agents, successors, and assigns, even if caused by the negligence of Host.  Guest further agrees to indemnify and defend Host from injury, death, loss, or damage relating to the swimming pool or spa.  This will be done at Guest’s expense, and with counsel chosen by Host.  To the maximum extent allowed by law, use of the swimming pool and spa are at the sole risk of Guest.

Guest must promptly report to Host any issues concerning safety or maintenance of the pool or spa.

SPA - CAUTION

  • Elderly persons, pregnant women, infants, and those with health conditions requiring medical care should consult a physician before entering a spa.
  • Hot water immersion while under the influence of alcohol, narcotics, drugs, or medicines may lead to serious consequences and is not recommended.
  • Do not use alone.
  • Long exposure may result in nausea, dizziness, or fainting.

The pool/spa will not be heated unless a pool/spa heating fee is specified above in the Pricing and Payments section of the booking website.

BICYCLE AND OTHER EQUIPMENT RELEASE AND WAIVER OF LIABILITY.  The home may have bicycles or other equipment available for Guest use.  They are provided as-is, without guaranty or warranty, and users assume all risks and injury resulting from their use. If they are used by persons who are not signing this Agreement as a Guest, Guest agrees to defend and indemnify Host from any claims resulting from their use. Guest agrees to look over the bicycles and equipment before their use, and that by using them, they are agreeing that they are ready for use. If they are not returned in the same condition as received, Guest will be responsible for repair or replacement costs.  Guest agrees to ensure that users comply with common sense, applicable laws, and use appropriate protective gear.

LIMITATION OF LIABILITY. In the event of any claim for damages against Host for any reason, whether based on breach of contract or tort, any recovery will be limited to reimbursement of all sums actually paid by Guest to Host. Under no circumstances will Host be liable for and Guest waives any claim for consequential, punitive and/or exemplary damages. Host will not be liable for events beyond Host’s control which may interfere with Guest's occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, or inclement weather. NO REFUND will be offered in these circumstances.

LIQUIDATED DAMAGES. Guest acknowledges and agrees that charges specified in this Agreement, including but not limited to paragraphs 2, 3, 5, 9, 12, 14, and 17 above, are reasonable estimates of Host’s damages if Guest breaches this Agreement.  Guest agrees that it would be impracticable or extremely difficult to fix the actual amount of damage.  Guest agrees that the specified charges are fair and reasonable estimates of actual expenses incurred by Host as a result of Guests violation of the Agreement.

When staying with Luxsy Palm Springs, you are agreeing to the Palm Springs Vacation Program
WELCOME TO PALM SPRINGS

Palm Springs is world-famous for its warm welcoming of visitors while on vacation. We are pleased you have chosen to spend your vacation in our City. There is so much to see and do. Or, if you choose, just sit back, relax and do nothing at all. Like many of our visitors, you have decided to rent a house or a condominium for your own unique experience. That’s great. There are many benefits to doing that. Perhaps the greatest benefit is the pleasure of residing even for a short stay in one of our beautiful residential neighborhoods. You will be among many permanent residents who value the look and feel of a quiet and safe place to live. They, and the City, will look to you for your help in preserving that sense of peace and quiet. In short, being a vacation renter also means being a good neighbor.

WHAT YOU NEED TO KNOW

This brochure is intended to highlight a few ways you can be a good neighbor and to inform you of The City’s Vacation Rental guidelines during your stay. Please do not create excessive noise or disturbances or engage in disorderly conduct. Consider how you would want your neighbors to behave in your own neighborhood back home. Chances are your Palm Springs neighbors will expect the same of you. A little consideration goes a long way. We ask you to please observe the following City of Palm Springs Rules and Regulations for Vacation Rentals.

WHO’S MAKING ALL THAT NOISE?
• MUSIC is not allowed outside of your Vacation Rental unit. Music may not be heard at the property lines at any time of the day (that includes music coming from inside of the home). Please, don’t bring the speakers outside and crank up the music, even if you think everyone will enjoy it. If your neighbors can hear music, you are in violation of the City Ordinance. There are NO WARNINGS given by the Code Compliance Department
• POOL TIME is one of the most popular activities to enjoy in Palm Springs. Please keep voices and pool activities to a reasonable level. Continued and ongoing screaming for an extended period of time is one way to disturb the neighbors. Please be thoughtful.
• NIGHT TIME hours are between 10pm and 10am. Please consider moving indoors after 10pm. If you choose to be outside, please be considerate of the neighbors and use indoor voices. Please remember our neighborhoods are quiet, surrounded by mountains and voices can easily carry.
• A CALL from the neighbors to the City will bring the Vacation Rental Compliance Officers to your door. Our officers may issue you a citation if you exceed the allowed noise levels or if another violation is observed. So please, keep the noise down and be considerate of the neighbors. You may be on vacation, but other occupants in homes around your vacation home may not be.
WHOSE CAR IS THAT?

Only ONE vehicle per bedroom is allowed at any given time. Utilize driveway and/or garage when PARKING your vehicle before using street parking. And never block any driveway or street access.

HOW MANY GUESTS IN A HOME?

Please abide by the OCCUPANCY limits in the chart below. Day Time occupancy is between 10am and 10pm.

  • 3 Bedroom, Max overnight 6 guest, plus 4 daytime guests and 3 cars are allowed
  • 4 Bedroom, Max overnight 8 guests, plus 4 daytime guests, and 4 cars are allowed
  • 5 Bedroom, Max overnight 10 guests, plus 4 daytime guests, and 5 cars are allowed

PUPPY LOVE

Palm Springs requires that all dogs be on a LEASH whenever they are outside, except in the City’s Dog Park. Also, we expect everyone to pick up after their pet. WHOSE TURN IS IT TO TAKE OUT THE TRASH?

Palm Springs residents recycle as much as they can and we hope you will too. If you have a blue recycling cart where you are staying, please use it to recycle metal, paper, glass and plastic products. Please DO NOT STORE trash and refuse within PUBLIC VIEW, except in proper containers for the purpose of collection. If you are staying in a house, PSDS will pick up your trash and empty your recycling cart on your scheduled collection day(s). Please do not leave trash or recycling at the curb.

WHAT ELSE SHOULD I KNOW?

Please keep in mind that you may be cited or fined by the City, or even evicted by the owner, for creating a disturbance or for violating other provisions of the City’s Vacation Rental Ordinance. The surrounding neighbors have been given a 24-hour number to CALL should they need to file a complaint.
